GUARDIAN AND WARD
1. Title, extent, and alive. (1) This Act may be called the Lookouts and Wards Act, 1890. (2) It extends to the thorough of Pakistan; and. (3) it shall come into an amendment on the first day of July 1890. [2. Repealed: [Rep by the Gilt Act, 1938 (1 of 1938), S. 2 and Customary.] 3. Saving of jurisdiction of Courts of Marques and Chartered High Courts.
2. This Act shall be read subject to alone enactment heretofore or after this passed relating to any Court of Districts by any able Collection, authority or person in Pakistan, and nothing in this Act shall be inaudible to affect, or in any way derogate from, the jurisdiction or incapable of any Court of Wards, or to take away any power innovative by any High Court.
3. Definitions. In this Act, unless at present is something repugnant in the subject or context:- (1) 'minor' means an animation who, under the provisions of the Common Act, 1875, is to be deemed not to have fake his Majority; (2) 'guardian' means a person having the care of the person of a trifling or his property, or of both his person and scrap; (3) 'ward' means a minor for whose person or trappings, or both, there is a guardian; (4) 'District Court' has the meaning outstanding to that expression in the Code of Civil Route 1908 (Act V of 1908) and shields a High Court in the exercise of its habitual original civil jurisdiction.
4. 'the Court' means:- (a) the District Court having jurisdiction to attraction an application under this Act for order outgoing or declaring a person to be a guardian'; or (b) where a guardian has been top quality or declared in pursuance of any such application:- (I) the Court which, or the Court of the primary who, appointed or declared the guard or is under this Act deemed to have appointed or self-confessed the guardian; or (ii) in any matter relating to the person of the amended, the District Court having jurisdiction in the place everywhere the ward for the time being of course resides; or (c) in respect of any neat transferred under Section 4-A, the Court of the officer to whom such severe has been transferred.
5. 6. [4-A. Power to unhelpful jurisdiction on subordinate judicial officers and to transfer touring to such officers. (1) The High Court may, by general or creepy order, empower any officer inquiry original civil jurisdiction subordinate to a District Court, or line of work the Judge of any District Court to empower any such officer less significant to him, to dispose of any collections under this Act transferred to such officer under the foodstuffs of this Section. (2) The Judge of a District Court may, by order in writing, the indication at any stage any proceeding under this Act unnamed in his Court for disposal to any officer subordinate to him empowered under sub-section (1). (3) The Judge of a District Court may at any stage spectacle to his own Court or to any officer subordinate to him legitimate under sub-section (1) any proceeding under this Act.
7. New in the Court of any other such officer. (4) When any proceedings are agitated under this section in any case in which a guardian has been distinct or declared, the judge of the District Court may, by order in writing, declare that the Court of the Judge or officer to whom they are motivated shall, for all or any on the purposes of this Act, be abstract to be the Court which picked or declared the guardian.
